Hello Rialto Now readers and fans. If you were watching from the audience or watching on TV it looks like every council meeting will go on and on no matter how short the agenda may appear. This meeting had six tab items in total and even had one pulled and at 9pm they only moved through half of the tab items.
Consent Calendar
Two items were pulled from the Consent Calendar for seperate approval or vote.
C.1 the regular city council meeting minutes from the meeting January 13th 2015 had a seperate vote and Councilman Ed Palmer voted no. We plan to reach out to Councilman Palmer this weekend and find out why he voted no on these minutes and we will update so stay tuned.
E.4 was pulled to explain that the City Treasurer wanted approval from the City Council to allow a few select investments go beyond the 5 year maturity limit to retain maximum benifit and a larger profit.
Tab Items & Public Hearings
Tab.1 was approving the ability to move forward with the Lytle Creek Development project. the developers need approval from the City to present the anexation application to the Local Agency Formation Commission for San Bernardino County this project in its entirety consitsts of 4 neighborhoods. Neighborhoods two and three will be anexed to the city of Rialto and Neighborhoods one and four will remain in the county of San Bernardino. Now let me first say I am not a fan of this project it has destoryed Rialto’s Country Club Area & Golf Course as well as extremely reduced property values in the Country Club Area. Nonetheless the developer has spent years and money going through stall tactics and lawsuits to finally get to this point. It appeared that even though there were questions about the real intentions of the project it was going to be approved to recive county approval, that is until Councilman Ed Scott spoke up. Councilman Ed Scott stated that since the developer had not come to him and meet with him privatly that he wanted to table this vote for two weeks. So this will be the second time just two months into a four year city council term that Councilman Ed Scott wants to delay things because he is unprepared. Also why should a developer be having special secret meetings with City Council Members? I know Councilman Ed Scott took alot of money from developers to get elected and that is one of the many reasons that I feel uncomfortable with Councilman Ed Scott acting as the Gate Keeper to Development here in Rialto. Councilman Shawn O’Connell had no problem voting to continue the item for two weeks but did say that when he has a question on an agenda item he calls city staff prior to the meeting and gets answers verses dropping them on staff in the meeting and creating delays. Councilman Ed Plamer said that this action has been delayed for far to long and voted no on continuing the issue for two more weeks.
Tab.2 was to approve one of the many warehouses that will be dropped in the city of Rialto. Niagra Bottling Company wants to bring a $200,000,000.00 bottling and packing warehouse to the Renaissance plan development operated by Niagra Bottling Company. Below is a image of the many diffrent companies they bottle and create water for:
As you see they bottle water for alot of different companies and they have a history of giving back. Thier were questions if they would add language holding the city of Rialto Harmless form any actions this project would ensue. I was unsure why they said that until I began reciving phone calls apperently WVWD and City of Colton are suing Niagara becuase they are taking too much water from the Basin appreently. That dosen’t bother me much they need to get the water from somewhere so I can buy it from Costco. Makes me wonder though how can Niagara turn nasty IE water into what I love to drink???? Oh this is the Tab item where Councilman Ed Scott tried to make it sound like he was the only one that executives from Niagara Bottling reached out to. It wasn’t until Councilman Shawn O’Connell said that the Niagara Reps reached out to all of the Council and Mayor.
Tab.3 was yet another warehouse in Rialto and though its going to bring jobs its also going to bring problems like increased truck traffic large buildings that normally have empty streets that attract street racing, drug use/sales and opportunities for other elicit behaviors. What is even worse is that this warehouse will be giving extra sales tax revenue to………. ONTARIO!!!!!! Yes our city has been working on this project for almost 10 years and have yet to figure out how to work a sales tax benifit for Rialto but man o man we sure know how to send that tax money elsewhere. Maybe we need San Bernardino to come in and show us how to secure a tax base from warehouses.
Take what you wish from this weeks Council Meeting but I think its time we show up more often and keep their eye on the ball.

The problems with Rialto and its budget are as follows.
- We refuse to make the right cuts, the needed cuts. We have attacked employee units that actually work for Rialto and ones that the community needs to function as a city. The city has sold off our water and waste water systems, attacked our fire and police & shut down city offices so much it virtually impossible to get anything done in a timely fashion. They changed graffiti contractors leaving residents in the lurch and at the mercy of resident gangs allowing them to re root in Rialto and add their tags to our walls and electric boxes. City hall refuses to tell the residents what our Mayor, City Clerk, City Attorney and other dept heads make. Our new mayor has already failed to reach out and be open with the public there are rumors swirling that she has ordered new paint and carpet for her office and is asking the city to waste tax dollars on sending her to Washington DC for a Mayors conference and to attend President Obama’s second swearing in, REALLY.
- The city became extremely way to comfortable with RDA funding which led to lazy council members ignoring the ugly business culture that is Rialto. We attract 99 cent stores, Walgreens, smoke shops, liquor stores, indoor swap meets and cash for gold businesses. It was an act of God to get our In&Out moving forward which according to In&Out is still in limbo. Fresh and Easy opened here but the latest word is that the company is abandoning the store concept which means yet another empty store front coming our way.
- Wasting time on failed projects that have further damaged our city:
- The city allowed Ron Phariss and his Lytle Creek Project to take up valuable council time, run our golf course and country club into ruin and create a riff between residents of the city and county areas. If Ron Phariss wants to build his development he needs to get going or get out.
- Wal-Mart claims they want a super center here in Rialto but they refuse to show the people of Rialto that they can operate a clean professional retail business in the Inland Empire. Wal-Mart hires lazy sloppy security for their parking lots and their staff remains rude and not helpful. Why would we welcome the super center if they can’t even offer Rialto residents a quality retail establishment at their current location? Also what happens to the old store once the super center is open, one more ugly vacant building for the homeless to destroy and gangs to tag up.
- The corner of Cactus and Foothill we have yet another gas station/carwash opening up even though there is a vacant falling apart carwash just east of this location. Where was the city leadership allowing another business to fall apart and become an ugly scar on our city and approve the same business to make a similar mistake just down the street?
Current council members and Mayor Robertson need to show us they are serious about working for the community and not just their own personal agendas. Joe Baca Jr. needs to focus on all areas of the cities not just parks. Mayor Robertson needs to figure out what she is doing and get back out into the community like she did when running for Mayor. She played a lot of us for fools by allowing us to think we would have an open line of communication with our Mayor if she was elected. Lets all hope that Councilman Elect Shawn O’Connell has the mental stamina to work in this council and see some positive forward progress. He is a man of strong character and has shown he wants to know and do the WILL OF THE PEOPLE. We must extend the Utility Users Tax in March, bring in new business to rialto, finish off half done projects and better utilize people in the community that have a desire to help make Rialto a better place to live.

Editorial: Rialto must fight financial crisis by taking action

OUR VIEW: Talks to rein in costs in Rialto need to give way to action, and the sooner the better.
It’s been almost three years since the Rialto City Council was warned that the city was facing its own serious financial crisis, potentially on par with the disaster that led to San Bernardino’s bankruptcy.
But rather than begin an aggressive campaign to trim costs and address a current $7.6 million budget deficit, the city seems more focused on convincing voters to approve extending a utility user tax set to expire in June.
Meanwhile, the city continues to spend its reserves to maintain services at current levels.
That sounds all too much like the scenario that played out in San Bernardino, where city officials depleted reserves and began borrowing from restricted funds to keep up with costs rather than make necessary cuts.
The situation in Rialto is dire – with its reserves expected to drop to $7 million by July, the budget stands to take an $11 million hit next year if voters reject the utility users tax during a special election in March.
Extending the utility tax in Rialto, keep in mind, won’t resolve the city’s ongoing structural deficit, the result of a sluggish economy and escalating personnel costs. The utility tax is a stop-gap that for now prevents the city from digging a deeper hole.
To be fair, Rialto has found some ways to cut costs, such as leaving vacancies unfilled and partnering with nearby
police agencies on some special services such as SWAT and helicopter patrols.
Such cost-savings measures have not been enough to balance the city’s books, however. And, if voters refuse to continue paying an 8 percent tax on their utility bills, the city’s General Fund will take a huge hit. The $11 million in revenue generated by the tax accounts for 22 percent of the General Fund, the city says.
Leaders at City Hall have said they expect to begin negotiating with labor groups to further reduce personnel costs, and there is some talk about restructuring the organization.
Those talks need to give way to action, and the sooner the better.
Those who live and work in Rialto need look no further than nearby San Bernardino for a cautionary tale about leaders who wait too long to take action. Residents who will be asked to continue paying an 8 percent tax on their utility bills deserve to know how the city is going to cut costs before handing over anymore of their own money.

So what I find funny in a scary way about all this is Rialto/RUA is looking to take out a $177 Million loan with $27.4 Million in existing debt. I was told that the overall rate is going to be between 7.25% & 7.5%. Yet the bulk ($144 Million) we will be paying 4.33% to 4.83% so the rates average out to be so expensive once we tack on existing debt. Why is that?
First of all because California has borrowed itself into a hole. That’s why governor Brown & a ton of other people have qualified tax measures for the November ballot. They have borrowed us into a massive hole and wont stop spending to save this state.
Second cities, school districts, counties and the state have been using bonds as a dirty band aide for their budget woes. Bonds were seen as good long term investments because municipalities made sure money was there for the bond payments to keep AA & AAA bond ratings or good credit scores. Now they just don’t have the money so they are defaulting on payments or just faulting altogether with Bankruptcy.
I have said time and time again, this deal isn’t good for the RESIDENTS in RIALTO! Yes the infrastructure needs to be upgraded but Rialto and the RESIDENTS are not in the position take on such massive debt while reaching into the pockets of struggling families. Do you know how we are going to pay the interest on this debt; we are borrowing money to pay the first three years. So that means we are borrowing more money than needed to pay interest on debt we cannot afford.
I have heard that this deal is worth $1 Billion to the parties involved. We need to stop this deal in its tracks, hold on and once our economy is back on track look into moving forward. Rialto will be $5 Million in the hole this year. Meaning we are using our reserves for what we can’t get out of our unions in the way of contract negotiations.
The amount of money we are in the hole ($5 Million) is the same amount that staff said was nessicary to bring all the county areas up to city code ($5 Million) since the city and the mangers of the Lytle Creek Development were strong armed by Josie Gonzales and the rest of the Board of Supervisors on the county board. They said if we wanted to annex the county areas in the proposed Lytle Creek Development we must also annex the areas already within our city limits. So when Ed Scott tells you that the water deal isn’t part of the Lytle Creek Development what are we supposed to think with this info. Looks like $5 Million is coming from the borrowed money to fund yet another project.

I have been told that this deal is also nessicary for attracting new development. What I find funny is In & Out is good to go for next year and Wal-Mart has won its lawsuits and plans to move forward with plans to re-locate to the empty lot on the corner of San Bernardino and Riverside Avenues (I don’t like this store). So why do we need 30 million dollars? To pay off the back room deals that Ed Scott and Ed Palmer have made with the Lewis builders (Target Developers) and Ron Pharrise the principle owner of the Lytle Creek Development. So once they have wasted the 30 Million dollars then what? Our CURRENT city government is so horrible at attracting real development that the community actually wants.
For example I have heard numerous council members say in reference to In & Out “we need more than another fast food place” or “we have enough burger joints”. We have too many crappy stupid chain fast food burger joints that hire the worst employees, pay the lowest wages and offer horrible customer service. On top of all that they offer a un healthy over processed food option.
In & Out is the best burger option in the State. They offer fresh quality food at a reasonable price. They also are and employer that looks for the best expects the best and pays a very fair wage. They are always clean, polite and productive. The next best option is Bakers but for some reason they are always right smack in the middle of the worst part of the city.
People in Rialto do you want to see this deal drag this city into ruin? How much more money do you want to give these defunct local legislators? Stop the back room deals and call them on this failed deal, also let’s vote for major change in November.

Hello everyone and good morning.
I am sorry I missed this meeting & that this council refuses to listen to the community. It seems that the only people they listen to are people who live outside of the city of Rialto as they did last night in reference to the Lytle Creek Development Project.

But that isn’t what were speaking on in this post, now its over the signatures collected in protest to the council’s decision to outsource our water to embattled American Water company.
The city attorney Jimmy Gutierrez (Mr I get DUI’s) he didn’t like the way the signatures were gathered and told the city clerk who informed council that they would not be putting the issue on the Ballot in November. It will never go before the people.

This council and Mayor do not care what you think or say unless forced to listen (IE the outsourcing the PD issue).
What is the disconnect with this council and listening to the residents. Ed Scott barks at residents from the dias like a junk yard dog (someone running for Mayor) Ed palmer just ignores you altogether, but at least Councilwoman Robertson will return a call as she did last night when I first got word of this horrible decision with the promise of another meeting in the next 2 weeks lets see if it happens.
Long Story short you have no say in the American Water Deal and we all will suffer for the next 30 Years because this city will never be able to afford to leave this contract ever.
We all must attend, watch council meetings and also call these people and make them finally listen to the people.

City of Rialto approves water rate increases, denies petition

RIALTO – The Rialto City Council on Tuesday voted to end the contentious issue of a whooping rate increase by voting 4-1 for its approval.The issue, and a related agreement to outsource the city’s water and sewer operations to New Jersey-based American Water Works Co. Inc., have been a boiling point for many residents for over a year.
The council’s action will propel water and sewer rates 114.8 percent by 2016.
Because the city of Rialto hasn’t increased rates for years, many residents recognize that rates need to go up, but think the increase should be spread out over more years.
Only Councilman Joe Baca Jr. opposed the rate increase.
As part of the meeting, the council decided not to schedule a referendum during the Nov. 6 general election on that outsourcing agreement – even though the city was presented with more than enough valid signatures to make that happen.
The petitions, gathered by the Utility Workers Union of America, did not include a copy of the concession agreement, Rialto City Attorney Jimmy Gutierrez said in an interview.
Under a provision of the election code, which Gutierrez said was written to encompass city ordinances, a copy of the ordinance must accompany the petitions “so that people know what they are signing.”
In those situations where there are other documents, courts have ruled that they too must be included, he said.
“You got to give all the information to the public,” Gutierrez said.
With the petitions circulated by the union, a copy of the city council resolution on the concession agreement was the only document included, he said. “How’s the public going to know what it’s signing without a copy of the concession agreement,” he said.
When asked how a document spanning hundreds and hundreds of pages, as is the case of the concession agreement, could be part of a petition being passed from one person to the next, Gutierrez said, “yeah, but that’s what the law says.”
Later he said that at least a summary of the agreement should have been included along with the petitions.
Contacted late Tuesday night, Utility Workers spokesman Mark Brooks said that the union’s legal team would need to evaluate the city’s position.
The union submitted 6,379 signatures and of those, 1,545 were declared invalid during a certification process conducted by the county Elections Bureau. That left 4,834 valid signatures – well above the amount needed to put the issue before voters.
During the council meeting, Mayor Pro Tem Ed Scott said that work is underway with city staff to modify the concession agreement in a way that will be “to everybody’s liking.”
He provided no details.
After the vote, resident Frank Gonzalez said, “I don’t agree with the results (of the Proposition 218 vote) but the citizens had a chance…I would like to work with you, even though I don’t agree with you.”
City Council’s vote on the rate increase was delayed to await the results of a Proposition 218 protest vote where a majority of the ratepayers – plus one – must file a written objection to the action.
The final tally for the water rate increase protest vote was 4,345, where 5,701 were required to block it. The sewer rate increases were opposed by 6,883, where 10,387 were needed to block it, Gutierrez said.
Councilman Ed Palmer accused the union’s Prop 218 campaign of producing many invalid and fraudulent votes.
“Thank goodness the vote wasn’t close, because the union would have forced us to physically account for very vote, a process that would have cost the city hundreds of thousands of dollars,” he said.
Palmer noted that his own signature was forged and sent into the city clerk’s office as a protest vote.
The Utility Workers union has several contract issues with American Water across the country and has opposed the company’s business expansion into Rialto.

Below is the form email that went out from SOS Water, the organization that is spearheading the drive to allow City of Rialto Voters to vote on the decision to outsource our water and waste water systems. I hope this push proves a few things to the city council and mayor of Rialto:
- Simple transperity isn’t enough when it comes to our water and a 30 year contract – Besides people who either work for the city, sit on a city commission/board or belong to a group or organization that is owned by the city government no one things that the information meetings were informative, they were more confusing. No other proposals were shown, staff presenting the information came off cocky and rude & people were left with more questions than answers.
- When the people (Rialto Residents) speak listen – 80+ people signed up to speak on the impending vote on water services & the city council choose to instead listen to Union reps, possible future business owners, labor lobbies & inappropriate city mouth pieces (Ref June Hayes calling one of the speakers a card carving communist). When Rialto business owners and residents filled 4 rooms and spoke their piece and you still chose to ignore it, you work for us remember that.
- For years this city government has made a choice to ignore the water system, now when RDA funds are gone we make a made dash for the first person willing to pay us off. How is this fair to the city? Why should the residents pay for your lack of leadership. It was best said today as Governor Brown was making his latest pitch for higher taxes he ask a reporter if she didn’t like his plan what did she think he should do and she said “THATS YOUR JOB”. IF the city water is in such disrepair then let’s get to work fixing it. Start off by using the 30 million dollars the Utility owes you and let’s get to work. Then lets talk about slow graduated increases that will hurt less over time to obtain the remainder of the money and finish the work. By the councils own admission this alone will bring business here that was avoiding us because of our water systems age and disrepair. I don’t agree that is why they are avoiding us but that’s for another post.
- SOS is comprised from people out-of-state that have seen American Water at work and know first hand what type of service they provide. This doesnt bother me one bit because without the hard work and passion of the people of Rialto their efforts would have died out eons ago.

Dear friends and neighbors:
On Saturday, May 12, we filed our petition with the City Clerk with substantially more than enough signatures to place the water privatization scheme before the voters of Rialto. Under California law, this means that the City will be required to present this critical issue to a vote of the people.
We needed 10% of the registered voters of Rialto to qualify for the ballot – or just over 3,600 signatures. Instead, we turned in more than 6,400 signatures!
The people of Rialto really came through to let City Council know that the voters of Rialto deserve to have the final say on this misguided 30-year privatization scheme.
The next step is that the City will review our petition to verify that we have submitted a sufficient number of valid signatures. After that, this issue should be presented to a public ballot sometime over the next few months. We will need to re-double our efforts to make certain this water privatization contract is defeated at the ballot box.
In addition, in the next few days we will be sending Prop 218 protest cards to all Rialto property owner who are affected by the huge rate hikes that the City Council is trying to push through to finance this deal. If a majority of property owners protest these rate hikes, then the City cannot impose the rate increases and the entire water privatization scheme fails.
We will keep you posted on both of these efforts as we move forward.

The final count is into the Rialto City Clerks Office.The Referendum Petition that we fought so hard for, 3 weeks of door to door asking all Rialto Voters to please sign and you did. We were hoping for min of 3500 and topping out 5000 for padding and our numbers are 6418, You did it. We the People of Rialto have spoken. Ok everyone we have recived the phone calls from both sides and with an issue like this in these economic times it can be hard to decifer the honesty and mistruths in both messages.
On one hand you have SOS Save our Water with a petition drive to undo the decision by the City Council and Mayor to sell off our water and waste water systems to American Water. The only Council Member to vote against this twice was Joe Baca Jr. who is running for Assembly.
I spoke to somone down at the city and this is the best I can decifer from both messages.
SOS Save Our Water (AKA AFL-CIO) – The union that represents the water workers dosen’t like this deal. So what they are doing is they have begun over the last couple weeks began circulating a petition to put on the ballot for the voters to decide on wheather they want American Water to actually take ownership of our systems. It does not effect water rates increasing, it just reverses councils decision. In my opinion this is a bad deal with the wrong company. Its just a last ditch effort to sell or water off for 30 YEARS for a small one time payment of 30 million dollers.
City of Rialto, Edward J Carrillo, Scott Beard, Midge Zupanic, Mayor Grace Vargas, Bill Perez & Randall Lewis – This group has Robo Called, wrote in the voice of the people and mailed out letters. They want you to believe that without American Water no upgrades will ever be done and the city will crumble around itself. Ok maybe the city falling apart was my adding of dramatics but not without a little help from the city goverment. There are other companies out there with better deals for residents, its the 30 million doller pay back that has council salivating. They keep calling the 30 million dollers Redevelopment money, they had better be careful lest the state takes ownership of that money as well. If all else fails let the current employees do their job and slowly upgrade our systems. What your telling us is the people the city employed to do the job can’t meaning you don’t know how to hire the right people. Also I really dont understand how a private company can get better deals on materials and supplies but a City can’t. Cities have resources like legislators, County Supervisors and others that can help them get those great prices on supplies. Hey if Lewis Comercial Properties want to build here so bad why can’t they or Ron Pharris help the city barter for reasonable prices. With the right protection and projects Rialto is a reat place to bring your business because so many of us shop well outside our community for entertainment and day to day needs.
City office said if you don’t like the American Water Deal feel free to sign the Petition, But if you want to battle the water rates only then you must mail or walk in a letter of protest with the following information.
Name, Adress or APN & Signature. These three things must be on your letter I am signing the petition and sending out a letter and I suggest that the rest of the city does the same.

Who Really owns Rialto?????
Below is a letter from the San Bernardino Sun Newspaper from realeste developer Randall Lewis. In it he makes it sound like what the city council did by voting to outsource our water department was a good thing. What it really boils down to is a group of lobbies that are getting well fed while the rate payer suffer for the next 30 yrs. What people like Midge Zupanic, Max & Pualine Tiddler, the Mayor and all of council don’t seem to understand is we can swallow the idea that rates may need to be adjusted, and that the repairs that THEY have failed to implement over the years need to be done. But what we don’t need to do is:
- Promise American Water or any other company a 30 year contract that runs like a mortgage, meaning if we get a few years into this and find out they couldn’t deliver on their promises we are on the hook to re-pay 130 million early termination charge that reduces by 4 million for every year until the end of 30 years.
- Promise American Water or any other company 30% profit every year for 30 years.
- Use the 30 million dollar pay off to line the pockets of developers like Ron Pharris or Randall Lewis.
- To pander to one union while stabbing another in the back.
The reason you have petitions in circulation right now is the AFL-CIO/TEAMSTERS will lose the shop because it will no longer be a union shop, the current employees are only guaranteed their jobs for a year and a half after that there is no promises of jobs. So while they are singing the praises of creating jobs in the industry of construction of the water system upgrades, they are signing the pink slips for every water and waste water employee & their families. Our Mayor and city council sold their own people down the river for the promise of a Target Shopping Center, a Super Walmart (which is still in litigation), a Lowes and then maybe we will finish the In and Out Project. Most of this money (30 million Dollar pay off) will be given to Randall Lewis for his “Target” Shopping Center. Our water employees family’s will suffer because of this councils actions and the prior ones inactions.
- Fail to give the community the ability to decide. People have to force the city to seek out what the public thinks and wants to do.
Most of the proponents of this Sale are Elderly meaning they Qualify for the 20% discount for low-income and senior citizens. Also meaning that they wont be alive to see the end of this bad deal. Yet we will all suffer their ill-informed, illegal decision.
So when you get recorded calls from the city telling you not to sign the petition and allow democracy to decide this very important decision, or the city manager mayor and sell Rialto down the river lobby (Randall Lewis and Ron Pharris) write letters to the sun stating how great this is and that we should be proud of this council and mayor. Listen to what their not saying. If you see them tell them what you think and ask them why we didn’t hear any of the other proposals from local companies working with local water and waste water systems. Ask them if they will repeal the brown lawn ordnance since we will no longer be able to afford to water our lawns. Ask them if they even CARE.

A city’s economic vitality is based in large part on its ability to create jobs and it’s commendable to see that the leaders of Rialto understand that necessity. The city has faced difficult choices and will face more in the months ahead as it positions itself for an economic recovery that will favor those communities with the infrastructure to compete for new businesses.We understand that growth requires investment, and appreciate what Rialto has done in that regard. Recently, the City Council took the difficult step of raising water rates, with the very specific intention of reinvesting in the community to help make Rialto more competitive.
However, it doesn’t end there. With the loss of redevelopment agencies, cities need to be more resourceful and visionary than ever. They need to address challenges head on and turn them into opportunities.
By taking bold steps, Rialto is fulfilling its promise of a “2nd Century of Progress.” That bodes well for the city’s economy and its ability to provide residents with the essential services they’ve come to expect.
