Local Community Advocates Stop Water Meeting In It’s Tracks

On Monday October 12th West Valley Water Board held a “SPECIAL” meeting to address issues that arose from the October 8th regular board meeting. We covered the “SPECIAL” meeting in a previous post to give the public a better idea of what was going to take place at noon on a Monday workday. At the meeting we saw a powder keg of emotions and Electioneering going on while the Water Board of Directors went into an early Closed Session meeting to come to an agreement to fire their current legal counsel from the firm Redwine and Sherrill and to proceed down a path of a dangerous General Public Agenda that from the talk in the crowd was ripe with violations of the Brown Act the very set of rules that dictates how elected boards are to be run and handle themselves. This meeting never made it past the first item on their public agenda.

The water Board legal counsel was not invited into the closed session we found out later it was because there had already been a decision to fire him and his firm possible Brown Act violation #1

The first general agenda item was listed as Appointment of Special Counsel. Many in the crowd had an issue with the vague nature of the item in question and once the public began speaking out it was more clear what this “SPECIAL COUNSEL” would be tasked to do. This special counsel was apparently going to be given marching orders to put a negative shade on two people currently running for the water board. Clifford Young the Vice President of the Board had a very angry look on his face and his comments and body language were very aggressive. I spoke on record about the costs of hiring an attorney just to sully the reputation weeks before an election of two people seeking seats on the board and asked how that was fair to the rate payers. I also spoke to Mr. Young and his aggressive posture and the message that was sending to the audience.

After I spoke Mr. Young got up and proved that he was out to cast negative shade over current Board Director Alan Dyer and Former West Valley Water District General Manager Butch Arizia who is running for one of the three seats open for this election. Even though the attacks on Mr. Arizia were proven false still on social media the group out to take total control of the Water Board still post these types of statements:

This meeting had about 20 local residents out asking a lot of good questions and the two words of the day were TRANSPARENCY & BROWN ACT VIOLATION. Mr. Young was affected by these mentions of the Brown Act and the potential violations that existed within the make up of the Special Meeting Agenda that he started to call out the people making the accusations and the people he was speaking too should know their Brown Act pretty well they all have had to abide by it pretty recently. These people were former Councilwoman Lynn Hirtz, Councilman Shawn O’Connell and Private Investigator Thompson all had words of caution for the board if they choose to proceed. The list of potential Brown Act violations are listed here:

  1. The meeting itself and the timing of the meeting.
  2. The appearance of more than two Board Members meeting and deciding on the issue of firing the current legal counsel.
  3. Putting out information at a board meeting that would harm or sully the reputation of a fellow board member or other person running for a board seat.
  4. Calling for a vote on allowing the General Manager of the Water District to find alternate legal counsel for the Thursday regular meeting without it being on the agenda or calling the meeting a emergency meeting.
  5. The attempt to hire a person that would only report to the board of directors.

If you look at the agenda for tomorrow little has changed except the Confidential Assistant that will report only to the Water Board has gone from a public item to a Closed Session Item.

The meeting is tomorrow at 3pm at 855 West Baseline Road it appears this one will be just as exciting as Monday.

Mayor Robertson Double Speaks On Cuba Sister City Issue

If you have been paying attention then you know that Mayor Robertson & Councilman Ed Scott want Rialto to have a sister city. A presentation was done on March 24th to show the council what this Cuba event would look like.

During the presentation the travel agent giving the presentation never mentioned the forming of a sister city with any city in Cuba because of the existing US policies that prohibit such an action. What the travel agent did say is that the Rialto sponsored trip to cuba would be an educational trip to learn about the food, culture and geography of Cuba. I wish I could show you that footage but the city has since taken down the video from that meeting.

I stood before our mighty elected officials and told them to just say what they really want to do. I told them especially Mayor Robertson let your yes be yes and your no be no were not stupid we will remember you lied come election day. Did anyone heed my warning? No they all stuck to the story that the sister city concept was not something anyone was actively seeking. Then I went to google and typed in Rialto Cuba Sister City and guess what I found:

Throught this interview with http://www.scpr.org Mayor Robertson speaks about a Sister City with a Cuban City. She tries to create the illusion of a cuban culture here in Rialto when most people who grew up here or lived here have never met a Cuban person connected to Rialto.

Here Mayor Robertson claims that Globus is acting on the cities behalf using the people to people program to solicit a Sister City relationship within  Cuba.

Rialto PD Honors The Fallen NY Officers

Rialto Police Benefit Association & Jet Blue made it possible for two of Rialto’s Finest to honor Officer LIU & Officer RAMOS who were gunned down in their squad car in NY City.

As you will see in the paragraph from the Rialto PD Facebook page https://www.facebook.com/RialtoPD Corporal Cunningham & Officer Pulido are members of the Rialto PD Honor Guard. Honor Guard members are versed in the proper rituals when presenting at any public event and especially funerals. Also both men are wonderful Rialto Police staff and Cpl. Cunningham is the two time winner of the battle of the badges Chilli Cook Off held at the Annual National Night Out event every August.

“On December 27, 2014, two of our Honor Guard Members, Corporal Gary Cunningham and Officer Javier Pulido attended the service of New York Police Officer Rafael Ramos. Veolia Water Workshop Round 2

On our city council update we left you hanging because TAB 7 was pushed off until the next council meeting so that it could be addressed at the Water Workshop tonight. Veolia apparently took on a contract they can’t deliver.

 

TAB 7 from the last council meeting is Veolia was required to provide 4000 meters at a cost of $460,000 water meters, but because they failed to check the contract they only want to provide 1600 meters at a cost of $390.000 why can Veolia pick and choose what part of the contract they can follow? Do the residents have the option of when to pay their bills?

 

What is this contract and what is this workshop for tonight? Veolia agreed to take over water and waste water services for the next 30 years and were tasked with conducting a major infrastructure overhaul of the city’s water delivery system and waste water removal system. They have already and will continue to levy major rate increases on Rialto Water customers and they have paid $40 million dollars to the city of Rialto for this utility take over. What they did is take your money and make excuses for being behind by 1-2 years on many projects because they claim that American Water (the cities first choice for a water servicer) wrote a bad contract that can’t be delivered on the originally agreed terms.

 

Veolia isn’t new to Rialto they have been around working with our waste water services for years. So they can’t claim ignorance to how Rialto is structured or set up. There are two major issues with the delay one is Rialto Water Services customers are already one full year into a four year rate increase schedule. Two if this process is delayed too long the interest rates on the loan that was taken out to make the capital improvements will eat into the money needed to afford these projects. Back in June at the first workshop Veolia upper management was asked by Councilman O’Connell in the meeting if they would cover this gap if the situation arose and they said NO.

 

Back at the first Water Workshop in June the city council found out that Veolia has been hiding behind a lame excuse of we didn’t write this contract. The community’s response to that is you signed it before reading it? What Veolia saw was an opportunity to take the rate payers for a ride and leave us with no other recourse. This contract was written in a way that city hall has thrown its hands in the air saying were stuck!!!!!!!

 

Anyone watching the news and all the problems with Los Angeles’s DWP is having with blown water lines knows that’s not where we want to be. The problem is everyone is acting like they are powerless to make Veolia do their job. Ironically a week after the first water workshop in June the city experienced a sewer back up that spilled into the streets. What is more irritating is that the Capital Improvement Projects not being completed and the massive rate increases is not the end of the problems with Veolia. Here is a short list:

  • Water meters are not being read they are being estimated. This means you are not likely to see any change in your water bill even though you’re cutting back on water usage.
  • Horrible customer service. Veolia doesn’t seem to have a customer service supervisor Monday thru Friday because when they mess up your bill you have to wait weeks to receive a call back if you receive one at all.
  • Lagging on processing payments. Veolia is slow to check the collection bin at the city of Rialto Civic Center and processes payments very slowly; you will get a late fee.
  • Horrible water pressure. Since Veolia has taken over Rialto Water Services customers have noticed a major drop in water pressure.

 

Now is the time to get involved and engage. This is an election year and was in the thick of it. Now is the time to demand action and we have some resources for you.

Suprise Special Council Meeting

So those of you using water services its time to listen up. It appears there is a “Public Hearing” scheduled for tomorrow in regards to the financial performance of Table Rock Capital & the performance of Veolia as our water & waste water provider. What you didn’t know? Well that’s because someone at city hall doesn’t want you there. The meeting was hidden in the city calendar with no title unless you click the highlighted date. Even then it only states that its a special council meeting. Then you must dig through the confusing agenda procedure to find the agenda (here is the link) https://rialto.legistar.com/Calendar.aspx

Oh and don’t worry everything is very confusing and hard to understand so here are the last minute bullet points we were able to pull out.

  • The spending is and was out of control, money is going into local consultants pockets to the tune of around 8 million dollars.
  • RUA reserves were depleted to the tune of 3.4 million dollars.
  • Your rates have gone up to cover infrastructure costs yet no improvement have been made and the ones that have been scheduled have been delayed again.
  • Veolia has spent your money moving into a new building and delayed doing their jobs.
  • Veolia claims your customer service problems are minor and not an issue.
  • The main reason for this agreement was to have the money to shut down the airport for a Target Shopping center is a thing of the past as Target has been out of the deal for years.
  • From all appearances we are stuck with this deal until 2042!!!!!!!!!!!
  • City Clerk Barbara McGee refused to honor the communities petition.
  • Table Rock Paid 1 million more than necessary to remove American Water from the agreement.

Does anyone have the presence of mind to call Table Rock Financial and Veolia on the carpet for what they have done and not done? Are you tired of paying more money for below par service and a company that has worst customer service than the Ca. DMV? Well tomorrow you have the right and ability to have your questions answered or air the horrible customer service that Veolia really provides the customers in Rialto.

So on Tuesdays Council Meeting we had some serious shenanigans going on.

Council Woman Robertson had made statements prior to Tuesdays meeting that she was demanding that Rialto PD pay their full 9% pension costs or she would be the one to vote no on placing the extension of the UUT on the march ballot. So what did the Police do? They did what was in the best interest of the citizens and agreed to pay their full pensions.

So since she got what she wanted the she voted yes, right? Nope she clearly wanted more. She still voted no citing that she wants the police to do more.

After her no vote the council went straight into another closed session. While in the closed session Rialto Police Benefit Association President Richard Royce debunked the notion the police offer was anything more than their way of helping the city and Community and had no conditions as stated by George Harris with city staff. When asked what more does she want Royce said he had no idea.

Our police have given massive concessions over the years from loosing uniform allowances, cost if living, pay reduction and now paying their full retirement.

So after closed session they decided to go with our wishy washy city attorney Jimmy Gutierrez new interpretation of the law regarding just when this vote must happen. For the longest time they have said this vote must be done by the end of November. Jimmy stated that it’s his offices interpretation that they have until December 8th. Why it changed is indicative of what we saw Tuesday.

First off we saw council woman Robertson and city attorney Gutierrez having a dozen side conversations.

Second we saw council woman Robertson bring up the opportunity to delay this vote prior to rejecting it with her no vote.

So now they postponed the vote or finalizing the vote till Monday it leads us to ask what more does she want? Whatever it was she got it and its big, so big no one will speak if it. Not even off record!

The good part is in a message from Deborah Robertson she has been satisfied with the pound of flesh and blood she let from our police to vote with the fellow council members on Monday.

Here is what she said to me:

The changes have already been resolved. RPBA met with me and we appear to be good on my end and they indicated they are good as well. It was a good meeting!

This week I David Phillips learned another hard but valuable lesson.

I had a long conversation with Mrs. Deborah Robertson about her intentions with our police department. She did state that her only intention was pension reform but she never said at the cost of 22% of the cities budget. Yes she is holding her Vote on the Special Election Hostage over the Police officers paying their full 9% pension costs. Her statement to me was my goals while in office havent changed since my campaign.

She has this power for many reasons:

  1. The biggest reason she has this power is the council took the entire month of October off for the election. Knowing full well the decision on the special election must be made before December 1st to make the deadline for the special election in March (Utility Users Tax sunsets in June 2013). This gives Deborah the leverage necessary to squeeze the Police for what she wants now.
  2. The tax Measure “V” that just died over the cities inability to be straight and honest with the community.
  3. Talk of the PERS tax being re-instated.
  4. That the last 2 chiefs have rebuilt the police into something we can be proud of and staffed the department with people that will bend to a TYRANT forcing her will upon the electorate to see the awesome programs and resources not be lost at the cost of severe arm twisting. FYI the police have taken concessions for the last 4 years with no end in sight.

So whats the solution?

First its supporting the Utility Users Tax at 8%. All council members stated they dont support raising it beyond that point at the workshop last Tuesday.

Second email, call and text Deborah Robertson and tell her what you think of her hard line stance and what it does for her ability to show she wants to work with the council and the community rather than fight us and try to rule with an IRON FIST.

Deborah Robertson is holding the communities ability to decide on the need of the Utility Users Tax hostage. She has made a strong ultimatum to the cities most important barging unit. Pay you full 9% pensions or I vote no one the Utility Users Tax Special Election. We must show our support for these men and women to have enough time to discuss this impact on their families. The vote on the Special Election must be unanimous one no vote and it doesn’t happen. Plus because council went dark in October this is it. If the vote doesn’t happen in November the special election wont happen prior to the tax unset in June.

We need a mass showing of resident support for these vital men and women. Make signs and show up.

Halloween Hi-Jinks

The City of Rialto’s “Halloween Hi-Jinks” is an annual event that is held in downtown Rialto on Halloween night. This event takes place Wednesday, October 31st, on Riverside Avenue between Rialto and First Street from 6:00 p.m. to 9:00 p.m. This is a free, family friendly event with a costume contest, guess the weight of the giant pumpkin contest, games, food and lots of candy.
